Terms and Conditions

General

These Terms & Conditions apply to all transactions between us, "Gift Horse", and you, "The Customer". They do not affect your statutory rights. We recommend you read these Terms & Conditions carefully.
We may change these Terms & Conditions at any time. All changes will take effect on the date they are posted on our website.
These Terms & Conditions are governed by English law and are subject to the non-exclusive jurisdiction of the English Courts. We do not accept amendments to these Terms & Conditions.
Failure by us to enforce any of these Terms & Conditions will not affect our right to enforce the rest of these Terms & Conditions.

Customer Orders

We will treat each order for goods as an offer by you to purchase the goods subject to our Terms & Conditions.

You must be 18 or over to order items from our catalogue, whether online or by telephone. All orders placed online will be acknowledged by email and all orders place by telephone will be acknowledged verbally at the time of order. Please note that order acknowledgement does not constitute order acceptance.
Your order will be accepted and the creation of a legally binding contract between you and Gift Horse will take place once we have dispatched the goods or they have been collected from the store.
We may decide to decline all or part of your order for any reason, in which case, we will inform you by telephone or email.
When deciding whether or not to accept your order we may use certain information about you, including credit reference agency checks. This helps to protect us both against fraudulent transactions.

The total price payable, including delivery, will be stipulated at the time you place your order, whether or not the order has been acknowledged. We are entitled to make adjustments to the price to take into account increased suppliers prices, or the imposition or rise in taxes and duties, or if due to an error or omission the price published for the goods is wrong. We will inform you of the correct price and offer the opportunity to take the goods at the correct price or cancel the order. All prices include VAT at 15% but exclude delivery charge. The delivery charge will be detailed when you are ready to place your order.

All our goods are subject to availability. If for any reason we are unable to deliver your items we will inform you by telephone or email. Unless you tell us otherwise, we will put any out of stock item onto backorder and dispatch when we have received new stocks.

Order Processing & Tracking

Your order is sent direct to a secure till in our shop for processing. Once we have received your order and payment our staff will pick, pack and dispatch your order. Our aim will be to do this the same day, Monday-Friday (except Bank Holidays) for all orders received by 3pm. We may dispatch on Saturdays at our discretion.
You can track the status of your order at any time by logging into your account.

Credit Card Security (Protx)

We use the industry leading payment company, Protx, to protect your card details and protect us from fraud. The following security systems are used:
• Transaction Security – All transaction information passed between merchant sites and the Protx VSP Systems is encrypted using 128-bit SSL certificates. No cardholder information is ever passed unencrypted and any messages sent to your servers from Protx are signed using MD5 hashing to prevent tampering. You can be assured that nothing you pass to the Protx servers can be examined, used or modified by third parties attempting to gain access to sensitive information.
• Encryption and Data Storage - All sensitive data is secured on Protx using the internationally recognised 256-bit encryption standards used by many blue chip companies and Governments.

Delivery

Delivery is charged as per each order. We aim to dispatch the same or next working day depending on when your order is received. If you wish to cancel your order after it has been dispatched you will be charged for both delivery and collection cost.

The charge for delivery will depend on the size and weight of your order. We will deliver to all UK postcodes using Royal Mail standard services. If you wish to have your items delivered by a courier please inform us immediately upon placing your order. We can provide you with a quote and any extra cost associated with employing a courier will be passed on to the customer before your order is finalised.
For more fragile items we may decide to use a courier service to deliver your items. In these instances please provide your telephone number.

We do accept international orders subject to the correct postal charge being applied to your order. We cannot be held responsible for your package and its contents once it leaves the UK.

Please note: we are not responsible for the delay/non arrival of your package. Royal Mail/Courier firms will normally try to make two attempts to deliver before returning the item to their sorting centre. Please contact/visit your local Royal Mail Sorting Office if your package has not been delivered within five working days of the dispatch email to arrange collection or re-delivery. If an item is returned to us we will charge another delivery fee to re-post the item to you.

All orders placed within the UK have insurance included up to the value of £35. If your order is worth more than £35 we recommend purchasing extra insurance and we can provide you with a quote for this extra insurance before dispatch.

The photographs used on this site are either our own or have been supplied by our trade suppliers. Due to the constant change in designs, some items received on your order may differ slightly in colour and style to the photograph displayed on this website. This is particularly appropriate for jewellery items that are individually produced.

Returns Policy

At Gift Horse we would like you to be happy with your purchase. You do have rights under the Distance Selling Regulations. If you are not satisfied with the item(s) you have purchased you may return it to us within seven days of receipt for a refund providing the goods are returned to us in their original state and fit for re-sale. We reserve the right not to refund your transaction if the item is returned damaged or all or part of the original contents and packaging are missing or damaged. The customer is responsible for return postal costs. We strongly recommend using a Special Delivery service from Royal Mail or getting Proof of Posting from the Post Office as we will not be responsible for any packages that are lost or damaged in the post.

If your item is damaged in the post please inform us within three working days of receipt (UK only) and please provide evidence for your claim, eg a photo of the damaged item/package contents, as we will claim the damage from Royal Mail’s insurance scheme. Only return the items if we request you to do so. All orders are insured within the UK up to a value of £35 within your delivery charge. We strongly recommend extra insurance for all orders over this amount, of which, we can provide you with a quote. If your order is worth more than £35 and you have not requested extra insurance for your package, we will only pay the £35 maximum compensation as per the Royal Mail insurance scheme.

All international orders are sent at the customer’s own risk.

Customer Data

Your privacy as a customer of Gift Horse is important to us. We will only use the information you supply for the purpose of fulfilling your order, or offer any information regarding our goods and services that may be of use to you. If you do not wish to receive emails from us regarding new products, services or reminders please let us know. We will not and do not pass or sell on your personal details to any third parties.
